Scope

Rachel Roc S.R.L., Via die Tigli 4, 20020 ARESE-MILANO, (hereinafter "Rachel Roc“, „Rachel Roc Boutique“ or “RRB”) operates the internet site www.rachelrocboutique.com, an online shop for Rachel Roc products. Customers (hereinafter “Customer”) must be of full age. The Customer accepts these Terms & Conditions by checking the apposite field in the order page.

Products

Products presented
Rachel Roc Boutique aims to present the products on the web site as similar as possible to true-life. In particular for colours, it is unfortunately not possible to ensure an exact consistency between the illustration on the screen and the real appearance.

Products availability
Products availability is automatically updated. In the event that a product ordered is unavailable, RRB is entitled to terminate the contract. In this event RRB will inform the Customer, that the ordered product is not available. Eventual payments already effectuated by the Customer will be refunded.

Prices

Prices and taxes
The prices indicated do not include VAT and transport costs. On each product page, the price inclusive of VAT is also displayed.
The Italian VAT rate is of 20% and has to be applied to all sales to Customers of the European Union. For non-EU countries (for ex. Switzerland) products are invoiced without the Italian VAT. The Customer pays directly of any country specific tax.

Prices and promotions
Rachel Roc products are sold also in exclusive fashion stores. Prices and promotions indicated on the site are only valid for Rachel Roc Boutique and have no value for fashion stores.

Delivery and shipping costs

Countries
At the moment RRB delivers only to countries of the European Union and Switzerland.

Shipping address
Shipping will be carried out from RRB warehouse to the address given by the Customer. If the shipping address differs from the invoicing address, RRB will make a phone verification before the shipment is released.

Transport costs and delivery periods
The Customer may have the possibility to choose between different shipping options differing in terms of costs and rapidity. Transport costs can vary from country to country and are clearly indicate on the choice page. The Italian VAT is applied to transport costs for all shipments to EU countries.
The delivery periods indicated on the page Shipping are based on experience values and non binding for RRB.

Payments

The payment service is handled for RRB by PayPal, worldwide leader in electronic payments. PayPal belongs to the E-bay group and offers a very high level of security for transactions. Customer can pay with the most common credit cards or with an existing PayPal account.
An order is shipped only after receipt of the full amount due by the Customer (product price, shipment costs and taxes).

Quality-Warranty

Rachel Roc products are designed in Italy and 100% made in Italy with high quality materials and in compliance of Italian/EU labour and environment laws.
Rachel Roc products are subject to severe quality controls and each item is controlled a last time before it is shipped.

Returns

If the Customer has ordered a wrong size or simply does not like the product received, he/she is allowed to return it within 10 working days from delivery date. The detailed procedure for returns can be found under Returns Policy .

Retention of title

All goods will remain property of RRB until payment is received in full.

Liability

Compensation for damages caused by incorrect images, descriptions or prices or by delayed or cancelled shipments shall be excluded.

Privacy

RRB will manage Customer data with confidentiality and will only share it with companies fulfilling a part of the order (for ex. Shipping company). All credit card information (numbers, expiry dates etc) will be transmitted with an encrypted protocol (SSL) directly to PayPal (company that handles the payment process for RRB) to ensure that neither RRB nor third party have access to this information. Disclaimer of liability for third party links

RRB may provide links to other web sites controlled or offered by third parties. In such case, RRB is not responsible or liable for the availability and the content of those third parties sites.

Governing Law and General Provision

If any part of this Agreement is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions of this Agreement.

This Agreement shall be governed and construed in all respects by Italian laws, without regard to principles of conflict of laws and without application of the United Nations Convention of Controls for International Sale of Goods. Milan (Italy) shall be the place of jurisdiction in case of litigation.

Die Rachel Roc srl (GmbH), Via die Tigli 4, 20020 ARESE-MILANO, (nachstehend "Rachel Roc“, „Rachel Roc Boutique“ oder „RRB“) betreibt unter der Internetadresse www.rachelrocboutique.com einen Online-Shop, über den Rachel Roc Artikeln zum Kauf angeboten werden.
Kunden (nachstehend „Kunde“) müssen volljährig sein. Durch anwählen des entsprechen Feldes auf der Bestellseite akzeptiert der Kunde unsere Geschäftsbedingungen.

Produkte

Dargestellte Produkte
Rachel Roc Boutique bemüht sich die angebotenen Waren auf der Internet-Seite deutlich und weitgehend der Realität entsprechend darzustellen. Vor allem bei Farben kann leider nicht eine vollständige Übereinstimmung zwischen der Darstellung auf einem Bildschirm und der Wirklichkeit gewährleistet werden.

Verfügbarkeit der Produkte
Die Verfügbarkeit der Produkte wird automatisch aktualisiert. Sollte jedoch ein bestelltes Produkt nicht lieferbar sein, so ist RRB zum Rücktritt berechtigt. In diesem Fall werden wird RRB den Kunden unverzüglich darüber informieren, dass das bestellte Produkt nicht zur Verfügung steht. Sollte der Kaufpreis bereits entrichtet sein, so wird der Kunde unverzüglich rückerstattet.

Preise

Preise und Steuern
Die angegebenen Preise sind exklusive Mehrwertsteuer und Transportkosten. Auf jeder Produktseite wir auch der Preis inklusive der Mehrwertsteuer angegeben. Die italienische Mehrwertsteuer von 20% wird für alle Kunden der Europäischen Union automatisch angewendet . Für Länder ausserhalb der EU (z.B. Schweiz) werden die Produkte ohne italienische Mehrwertsteuer verrechnet, eventuelle Landespezifische Steuern werden direkt vom Kunden bezahlt.

Preise und Promotionen
Rachel Roc Produkte sind auch in exklusiven Modegeschäfte erhältlich. Die angegebenen Preisen und eventuelle Promotionen sind ausschliesslich für Rachel Roc Boutique gültig und in keinerlei Weise für Modegeschäfte bindend.

Lieferung und Versandkosten

Länder die beliefert werden können
RRB liefert zurzeit in den Ländern der Europäischen Union und in die Schweiz.

Lieferadresse
Die Lieferung erfolgt ab RRB Lager an die vom Kunden angegebene Lieferadresse. Sind Rechnungsadresse und Lieferadresse unterschiedlich, so findet der Versand erst nach einer telefonischen Kontrolle statt.

Transportkosten und Lieferzeiten
Der Kunde hat die Möglichkeit bei der Bestellung unter verschieden Transportmöglichkeiten, die sich in Lieferzeit und Kosten unterscheiden, zu wählen. Versandkosten können von Land zu Land unterschiedlich sein und sind jeweils auf der Wahlseite angegeben. Auf den Versandkosten wird für alle Lieferung in EU Länder ebenfalls die italienische Mehrwertsteuer angewendet.
Die auf der Seite Shipping angegebenen Lieferzeiten basieren sich auf Erfahrungswerte und sind unverbindlich.

Zahlungen

Zahlungen an RRB werden über die Firma PayPal, weltweites Leader für elektronische Zahlungen, abgewickelt. PayPal, eine Firma der E-Bay Gruppe bietet sehr hohe Sicherheits-Standards. Kunden können mit den wichtigsten Kreditkarten zahlen oder direkt einem PayPal Konto.
Der Versand der Bestellung erfolgt nach Eingang der Zahlung vom Kunden des gesamten Betrages (Produktpreis, Versandkosten und Steuern).

Qualitäts-Garantie

Rachel Roc Produkte werden in Italien entworfen und zu 100% in Italien mit den besten Materialien hergestellt und unter Einhaltung der italienischen/europäischen ökologischen und sozialen Gesetze hergestellt. Alle Rachel Roc Produkte unterliegen strenge Qualitätskontrollen, vor dem Versand wird jedes Produkt nochmals einzeln kontrolliert.

Rückgaberecht

Ist der Kunde mit einem Artikel nicht zufrieden, so kann er/sie es innerhalb von 10 Arbeitstagen nach Lieferdatum zurückschicken. Auf der Seite Returns Policy sind die genauen Anweisungen für Rücksendungen angegeben.

Eigentumsvorbehalt

Bis zur vollständigen Bezahlung bleibt die Ware Eigentum von RRB.

Schadenersatz

Disponibilità die prodotti
La disponibilità die prodotti viene attualizzata automaticamente. Qualora un prodotto ordinato non dovesse essere più disponibile, RRB si riserva il diritto di recedere il contratto di vendita. In tale evenienza il Cliente viene immediatamente avvertito, che il prodotto ordinato non è disponibile. Qualora sia già avvenuto il pagamento, questo verrà rapidamente ed interamente rimborsato al Cliente.

Prezzi

Prezzi e tasse
I prezzi indicati sono esclusivi di IVA e costi di trasporto.
Sulla pagina prodotto è indicato anche il prezzo complessivo di IVA. L’aliquota IVA italiana del 20% viene applicata a tutti i clienti residenti in un paese della Comunità Europea.
Per i paesi extra Comunità Europea (ad esempio la Svizzera) i prodotti vengono fatturati senza aggiunta di IVA. Eventuali tasse specifiche al paese vengono pagate direttamente dal Cliente.

Prezzi e promozioni
I capi Rachel Roc sono disponibili anche in esclusivi negozi di moda. I prezzi indicati ed eventuali promozioni sono validi esclusivamente per la Boutique Rachel Roc e non hanno alcun valore per i negozi.

Consegne e costi di trasporto

Paesi ai RRB può vendere i prodotti
Al momento possono acquistare i prodotti da RRB unicamente i Clienti residenti in un paese della Comunità Europea o in Svizzera.

Indirizzo di consegna
La spedizione avviene dal magazzino RRB all’indirizzo di consegna indicato dal Cliente. Qualora l’indirizzo di consegna sia diverso dall’indirizzo di fatturazione, la spedizione avviene unicamente dopo un controllo telefonico..

Costi di trasporto e tempi di consegna
Salvo eccezioni, il Cliente ha la possibilità, al momento dell’ordine di scegliere fra modalità di trasporto differenti in termini di costo e tempi di consegna. I costi di trasporto, che possono variare a seconda del paese, vengono chiaramente indicati nella pagina della scelta. Anche sui costi di trasporto viene applicata l’IVA italiana per spedizioni nella Comunità Europea. I tempi di consegna indicati sulla pagina Shipping si basano sull’esperienza acquisita e sono da intendersi come indicativi.

Pagamenti

Il servizio di incasso dei pagamenti per RRB è gestito dalla ditta PayPal, leader mondiale per i pagamenti elettronici. PayPal appartiene al gruppo E-bay ed offre dei livelli di sicurezza altissimi per le transazioni. Il Cliente ha la possibilità di pagare per carta di credito o con un conto PayPal.
La spedizione avviene alla ricezione del pagamento del Cliente per la totalità dell’importo dovuto (prezzo prodotto, costi di trasporto, tasse)

Garanzia di qualità

I prodotti Rachel Roc vengono disegnati e realizzati interamente in Italia, con materiali di altissima qualità e nel pieno rispetto delle normative ecologiche e di tutela del lavoro italiane e/o europee.
I prodotti Rachel Roc vengono sottoposti a severi controlli qualitativi e prima di ogni spedizione ogni capo viene nuovamente verificato.

Diritto di resa

Articoli dalla taglia sbagliata o non di gradimento del Cliente, possono venire resi entro 10 giorni lavorativi dalla data della consegna. La pagina Returns Policy illustra le modalità da seguire in caso di resi.

Riserva di proprietà

Fino al completo pagamento dell’importo dovuto, la merce rimane proprietà di RRB.

Risarcimento danni

Sono escluse richieste di risarcimenti danni dovute ad eventuali errori o omissioni nelle immagini, nei prezzi o nelle descrizioni o a ritardi ed impossibilità di consegna.

Protezione dati

I dati forniti dal Clienti per lo svolgimento della attività di RRB Boutique vengono trattati con assoluta discrezione e forniti a terzi esclusivamente nell’ambito dell’esecuzione dell’ordine (ad esempio società di trasporto).
